Η Ευρωπαϊκή Επιτροπή ξεκίνησε νέα σειρά διαδικασιών επί παραβάσει, εννέα στο σύνολο, εναντίον της Κύπρου, καθώς η χώρα περιλαμβάνεται σε σειρά αποφάσεων για μη πλήρη και έγκαιρη μεταφορά ευρωπαϊκών οδηγιών στο εθνικό της δίκαιο. Οι υποθέσεις αφορούν την εργατική μετανάστευση, την προστασία του περιβάλλοντος, τις μεταφορές επικίνδυνων εμπορευμάτων, τις κεφαλαιαγορές, τις χρηματοπιστωτικές υπηρεσίες, τις επικίνδυνες ουσίες σε ηλεκτρονικό εξοπλισμό, τη γεωργία, την ισότητα και την εσωτερική αγορά σε περιόδους κρίσης. Οι διαδικασίες βρίσκονται στο αρχικό στάδιο, καθώς η Επιτροπή έχει αποστείλει προειδοποιητικές επιστολές και έχει καλέσει τις κυπριακές αρχές να κοινοποιήσουν τα μέτρα συμμόρφωσης εντός δύο μηνών. Σε περίπτωση που η απάντηση δεν κριθεί ικανοποιητική, η Επιτροπή μπορεί να προχωρήσει στο επόμενο στάδιο, εκδίδοντας αιτιολογημένη γνώμη, πριν από ενδεχόμενη προσφυγή στο Δικαστήριο της Ευρωπαϊκής Ένωσης. Αναλυτικά όσον αφορά τις χωριστές διαδικασίες, η Κύπρος βρίσκεται μεταξύ των 17 κρατών μελών στα οποία η Κομισιόν απέστειλε προειδοποιητική επιστολή για τη μη πλήρη μεταφορά της αναθεωρημένης Οδηγίας για την Ενιαία Άδεια (EΕ 2024/1233), η οποία αφορά το ευρωπαϊκό πλαίσιο για τη νόμιμη μετανάστευση εργαζομένων από τρίτες χώρες. Η νέα αυτή οδηγία προβλέπει ταχύτερη διαδικασία για τη χορήγηση ενιαίας άδειας διαμονής και εργασίας, με ανώτατη προθεσμία εξέτασης αιτήσεων τις 90 ημέρες, ενισχύοντας, παράλληλα, τα δικαιώματα των εργαζομένων μέσω της δυνατότητας αλλαγής εργοδότη, μηχανισμών καταγγελιών και προστασίας από εκμετάλλευση. Επιπλέον, κοινοποιήθηκε και η διαδικασία για τη μη πλήρη ενσωμάτωση της Οδηγίας για τα Περιβαλλοντικά Εγκλήματα (EΕ 2024/1203). Σε αυτή την περίπτωση, η Κύπρος περιλαμβάνεται στα 23 κράτη μέλη που δεν ενημέρωσαν την Επιτροπή για την πλήρη εφαρμογή των νέων κανόνων, οι οποίοι αυστηροποιούν το ευρωπαϊκό πλαίσιο για σοβαρές περιβαλλοντικές παραβάσεις και προβλέπουν αυστηρότερες κυρώσεις για πράξεις που προκαλούν σημαντική, εκτεταμένη ή μόνιμη περιβαλλοντική ζημιά. Η Επιτροπή έχει αποστείλει προειδοποιητική επιστολή και αναμένει διορθωτικές ενέργειες εντός δύο μηνών. Προειδοποιητική επιστολή έλαβε επίσης η Κύπρος για τη μη πλήρη μεταφορά των νέων ευρωπαϊκών κανόνων σχετικά με τους οδικούς ελέγχους οχημάτων που μεταφέρουν επικίνδυνα εμπορεύματα, βάσει της Κατ’ Εξουσιοδότηση Οδηγίας (EΕ 2025/1801). Η οδηγία επικαιροποιεί τις διαδικασίες ελέγχου, αντικαθιστά τον ενιαίο κατάλογο ελέγχων και αναθεωρεί τις κατηγορίες κινδύνου που συνδέονται με πιθανές παραβάσεις. Και σε αυτή την περίπτωση η διαδικασία βρίσκεται στο στάδιο της προειδοποιητικής επιστολής, με προθεσμία δύο μηνών για συμμόρφωση. Η Κομισιόν εκκίνησε επίσης διαδικασία επί παραβάσει κατά της Κύπρου για τη μη πλήρη μεταφορά της Οδηγίας Listing Act (EΕ 2024/2811), η οποία αποσκοπεί στην ενίσχυση των ευρωπαϊκών κεφαλαιαγορών και στη βελτίωση της πρόσβασης μικρότερων επιχειρήσεων σε χρηματοδότηση. Η διαδικασία βρίσκεται στο πρώτο στάδιο, καθώς η Επιτροπή απέστειλε προειδοποιητική επιστολή προς τα κράτη μέλη που δεν κοινοποίησαν ολοκληρωμένα μέτρα εφαρμογής μέχρι την προβλεπόμενη προθεσμία. Στο ίδιο στάδιο βρίσκεται και η διαδικασία σχετικά με τη μη πλήρη εφαρμογή της Οδηγίας EMIR (EΕ 2024/2994), η οποία εισάγει τροποποιήσεις στους κανόνες για τη διαχείριση κινδύνων από συναλλαγές παραγώγων, τη λειτουργία επενδυτικών οργανισμών και την εποπτεία χρηματοπιστωτικών ιδρυμάτων. Η Κύπρος περιλαμβάνεται στα κράτη μέλη που δεν ολοκλήρωσαν την ενσωμάτωση των αλλαγών στο εθνικό τους δίκαιο και καλείται τώρα να ενημερώσει την Επιτροπή για τα μέτρα που έλαβε. Παράλληλα, η Κύπρος βρίσκεται μεταξύ των επτά κρατών μελών κατά των οποίων άνοιξε διαδικασία επί παραβάσει για τη μη μεταφορά συγκεκριμένων τροποποιήσεων της ευρωπαϊκής Οδηγίας RoHS σχετικά με τον περιορισμό επικίνδυνων ουσιών σε ηλεκτρικό και ηλεκτρονικό εξοπλισμό. Οι τροποποιήσεις αφορούν εξαιρέσεις περιορισμένης διάρκειας για τη χρήση μολύβδου σε συγκεκριμένες εφαρμογές, χωρίς να μειώνεται το επίπεδο προστασίας της ανθρώπινης υγείας και του περιβάλλοντος. Η υπόθεση βρίσκεται επίσης στο αρχικό στάδιο της προειδοποιητικής επιστολής. Η Κύπρος περιλαμβάνεται ακόμη στη διαδικασία επί παραβάσει για τη μη πλήρη μεταφορά της Εκτελεστικής Οδηγίας (EΕ 2025/2449) σχετικά με τις διαδικασίες εξέτασης ορισμένων ποικιλιών γεωργικών φυτών και λαχανικών. Η Επιτροπή έχει ζητήσει από τις κυπριακές αρχές να αντιμετωπίσουν τις ελλείψεις που εντοπίστηκαν, με την υπόθεση να βρίσκεται στο στάδιο της προειδοποιητικής επιστολής. Επιπλέον, η Κομισιόν απέστειλε προειδοποιητική επιστολή στην Κύπρο για τη μη πλήρη ενσωμάτωση των νέων οδηγιών σχετικά με τα πρότυπα λειτουργίας των φορέων ισότητας (EΕ 2024/1499 και EΕ 2024/1500). Οι κανόνες αυτοί καθορίζουν ελάχιστες απαιτήσεις για την ανεξαρτησία, τους πόρους και τις αρμοδιότητες των εθνικών φορέων που αντιμετωπίζουν διακρίσεις. Η διαδικασία βρίσκεται στο πρώτο στάδιο και η Κύπρος καλείται να αποδείξει την πλήρη συμμόρφωσή της. Τέλος, η Κύπρος περιλαμβάνεται στα 24 κράτη μέλη στα οποία η Επιτροπή απέστειλε προειδοποιητική επιστολή για τη μη πλήρη μεταφορά της Οδηγίας (EΕ 2024/2749), που αφορά διαδικασίες έκτακτης ανάγκης για την αξιολόγηση συμμόρφωσης προϊόντων, την εποπτεία της αγοράς και τη λειτουργία της εσωτερικής αγοράς σε περιόδους κρίσης. Η συγκεκριμένη υπόθεση βρίσκεται επίσης στο πρώτο στάδιο της διαδικασίας επί παραβάσει. Συνολικά, η Επιτροπή εκκίνησε την Τετάρτη 15 διαδικασίες, με όλες οι νέες υποθέσεις κατά της Κύπρου βρίσκονται επί του παρόντος στο πρώτο στάδιο της ευρωπαϊκής διαδικασίας επί παραβάσει, δηλαδή στο στάδιο της προειδοποιητικής επιστολής. Η Κομισιόν αναμένει από τη Λευκωσία να αποστείλει πλήρη ενημέρωση για τα εθνικά μέτρα εφαρμογής μέσα στην προβλεπόμενη δίμηνη προθεσμία, και εάν η Κύπρος δεν ανταποκριθεί επαρκώς, τότε μπορεί να προχωρήσει στο επόμενο βήμα της διαδικασίας, εκδίδοντας αιτιολογημένη γνώμη.Πηγή: ΚΥΠΕ
