Το θέμα της 51ης Ταξιαρχίας Κομάντος βρίσκεται σήμερα στα πρωτοσέλιδα του τουρκικού Τύπου, με αρκετά μέσα να παρουσιάζουν τη μεταφορά της στο Σόκε ως μήνυμα προς την Αθήνα με κάποια μέσα μάλιστα να ανεβάζουν ακόμη περισσότερο τους τόνους, υποστηρίζοντας ότι οι Τούρκοι στρατιώτες «έχουν τεθεί σε επιφυλακή» στο Αιγαίο. Πολλά ΜΜΕ, ωστόσο, επισημαίνουν ότι η απόφαση για τη μετακίνηση είχε ληφθεί ήδη από τον Αύγουστο και, ως εκ τούτου, δεν συνδέεται ούτε με την επίσκεψη του Κυριάκου Μητσοτάκη ούτε με την «Ασπίδα του Αχιλλέα», αποδίδοντας τον σχετικό «θόρυβο» κυρίως στα ελληνικά ΜΜΕ. Νεφές: «Μήνυμα Σόκε στον Μητσοτάκη» Το πιο χαρακτηριστικό πρωτοσέλιδο ως προς τον τόνο του είναι αυτό της αντιπολιτευόμενης εφημερίδας Νεφές, που ερμηνεύει τη μετακίνηση ως ευθεία προειδοποίηση προς την ελληνική πλευρά. Με τίτλο «Μήνυμα Σόκε στον Μητσοτάκη», η εφημερίδα μιλά για «προειδοποίηση από την Άγκυρα στην Αθήνα για τα στρατιωτικοποιημένα νησιά» και υποστηρίζει ότι η ανάπτυξη της επίλεκτης μονάδας απέναντι από τη Σάμο έχει προκαλέσει ανησυχία στην Ελλάδα. Ιδιαίτερη έμφαση δίνει στον αριθμό των στρατιωτών, με αναφορά στους «2 χιλιάδες κομάντος» που, όπως χαρακτηριστικά γράφει, «φόβισαν την Ελλάδα». Σοζτζού: «Τελείωσαν την τρομοκρατία – Τώρα ήρθε η σειρά του “Αχιλλέα”» Η αντιπολιτευόμενη εθνικιστική εφημερίδα Σοζτζού συνδέει πολύ πιο καθαρά τη μετακίνηση με την ελληνοϊσραηλινή αμυντική συνεργασία και την «Ασπίδα του Αχιλλέα». Το πρωτοσέλιδο έχει τίτλο «Τελείωσαν την τρομοκρατία – Τώρα ήρθε η σειρά του “Αχιλλέα”» και κάνει λόγο για «το πρώτο βήμα κατά της ελληνο-ισραηλινής πρόκλησης». Η εφημερίδα υποστηρίζει ότι, απέναντι στο σχέδιο «Ασπίδα του Αχιλλέα» που «καλύπτει όλο το Αιγαίο», η Άγκυρα «δεν έμεινε άλλο σιωπηλή». Παράλληλα, υπενθυμίζει πρωτοσέλιδο της 14ης Σεπτεμβρίου, με το οποίο, όπως αναφέρει, «είχαμε επιστήσει την προσοχή στον κίνδυνο». Στο πρωτοσέλιδο επιλέγει τον τίτλο «Η Αθήνα και η Φιλανδία προτίμησαν το Ισραήλ», αλλά στο εσωτερικό της η εφημερίδα επιχειρεί να αποτυπώσει και την ελληνική αντίδραση, με τίτλο: «Φόβος για “2.000 κομάντος” στην Ελλάδα! Η εφημερίδα επισημαίνει, επομένως, ότι η μεταφορά δεν πρέπει κατ’ ανάγκην να διαβαστεί ως έκτακτη στρατιωτική κίνηση. Παράλληλα, αναγνωρίζει ότι η γεωγραφική θέση του Σόκε, απέναντι από τη Σάμο, προσδίδει στην ανάπτυξη ιδιαίτερο συμβολισμό στα μάτια της ελληνικής κοινής γνώμης. Τακβίμ: «Οι Τούρκοι στρατιώτες σε επιφυλακή – Οι τουρκικές ένοπλες δυνάμεις πάτησν το κουμπί» Σε σαφώς πιο έντονο ύφος, η φιλοκυβερνητική εφημερίδα Τακβίμ παρουσιάζει στην πρώτη της σελίδα τη μεταφορά της 51ης Ταξιαρχίας ως άμεση στρατιωτική απάντηση στις πρόσφατες κινήσεις της Αθήνας. Με πρωτοσέλιδο τίτλο «Οι Μεχμετσίκ σε επιφυλακή», η εφημερίδα γράφει ότι, μετά τις «προκλητικές επισκέψεις» του Έλληνα πρωθυπουργού Κυριάκου Μητσοτάκη στα νησιά του Αιγαίου, οι τουρκικές ένοπλες δυνάμεις «πάτησαν το κουμπί». Σύμφωνα με το δημοσίευμα, η ανάπτυξη της μονάδας είχε «ευρεία απήχηση» στον ελληνικό Τύπο και οι Τούρκοι στρατιώτες «άρχισαν τη σκοπιά σε κατάσταση προσοχής», προκειμένου, όπως αναφέρει η εφημερίδα, «να προστατεύσουν τις ισορροπίες στο Αιγαίο». Η Τακβίμ στις εσωτερικές σελίδες με τον τίτλο «Αστραπιαία απάντηση στο “σόου των νησιών”», σημειώνει ότι η Σάμος απέχει 40 χιλιόμετρα από την Τουρκία. Το δημοσίευμα συνοδεύεται από τη φράση «Οι καταδρομείς δεν θα αφήσουν “να πετάξει ούτε πουλί” στην περιοχή», ενώ καταλήγει με την επισήμανση: «Οι Τούρκοι περιμένουν σε επιφυλακή». Α Χαμπέρ: Στο επίκεντρο η ελληνική αντίδραση Το φιλοκυβερνητικό κανάλι Α Χαμπέρ εστιάζει περισσότερο στην ελληνική συζήτηση γύρω από την ανάπτυξη. Ο τίτλος είναι χαρακτηριστικός: «Οι τουρκικές ένοπλες δυνάμεις κάνουν αξιοσημείωτο βήμα ενάντια στην ελληνική πρόκληση: Η 51η Ταξιαρχία Κομάντο μεταφέρθηκε από το Τούντζελι στο Σόκε». Το δημοσίευμα συνδέει τη μετακίνηση με την επίσκεψη του Μητσοτάκη στο Καστελόριζο, τη Ρω και τη Στρογγύλη, αλλά και με την υπογραφή συμφωνίας για σύστημα αεράμυνας με το Ισραήλ. Κατά την TR Haber, η μεταφορά της ταξιαρχίας στο Σόκε, κοντά στη Σάμο, «προκάλεσε πανικό στα ελληνικά μέσα ενημέρωσης». Το Εφετείο ανέτρεψε την πρωτόδικη απόφαση με την οποία είχε αποδοθεί ποσοστό 30% συντρέχουσας αμέλειας σε μοτοσικλετιστή που τραυματίστηκε σε τροχαίο δυστύχημα, κρίνοντας ότι η σύγκρουση προκλήθηκε από την ξαφνική δεξιά στροφή οδηγού αυτοκινήτου, ο οποίος απέκοψε την πορεία του. Η υπόθεση αφορούσε αγωγή για γενικές και ειδικές αποζημιώσεις λόγω τροχαίου δυστυχήματος. Το Επαρχιακό Δικαστήριο Λευκωσίας είχε αρχικά καταμερίσει την ευθύνη σε ποσοστό 70% στον οδηγό του αυτοκινήτου και 30% στον μοτοσικλετιστή, επιδικάζοντας στον πρώτο υπέρ του δεύτερου ποσό €11.626, πλέον τόκων και εξόδων. Ο μοτοσικλετιστής εφεσίβαλε την απόφαση, υποστηρίζοντας ότι δεν έφερε οποιαδήποτε ευθύνη για το δυστύχημα, ενώ ο οδηγός του αυτοκινήτου καταχώρισε αντέφεση, ζητώντας μεταξύ άλλων αύξηση του ποσοστού ευθύνης του μοτοσικλετιστή και μείωση των γενικών αποζημιώσεων. Το Εφετείο, με απόφαση του Δικαστή Χαράλαμπους, έκρινε ότι η πρωτόδικη κρίση ως προς τη συντρέχουσα αμέλεια βασίστηκε σε εσφαλμένη αξιολόγηση των πραγματικών περιστατικών. Σύμφωνα με τα ευρήματα του πρωτόδικου Δικαστηρίου, ο οδηγός του αυτοκινήτου κινούνταν στην εσωτερική λωρίδα της οδού Αγίου Γεωργίου στη Λακατάμια και επιχείρησε να στρίψει δεξιά προς την οδό Αλαμάνας. Κατά την κρίση του πρωτόδικου Δικαστηρίου, δεν βεβαιώθηκε ότι ο δρόμος ήταν ελεύθερος και ότι η αντίθετη κυκλοφορία τού επέτρεπε να πραγματοποιήσει τη στροφή, με αποτέλεσμα να εισέλθει στη λωρίδα του μοτοσικλετιστή και να καλύψει περίπου 1,5 μέτρο της πορείας του. Η πρωτόδικη απόφαση χαρακτήρισε την ενέργεια αυτή ως «τη γενεσιουργό αιτία της σύγκρουσης». Ωστόσο, το πρωτόδικο Δικαστήριο είχε κρίνει ότι και ο μοτοσικλετιστής έφερε ευθύνη 30%, επειδή, παρότι είχε αντιληφθεί ότι οι κινήσεις του αυτοκινήτου ήταν «ύποπτες» και ότι η πρόθεση του οδηγού δεν ήταν ξεκάθαρη, δεν ακινητοποίησε εγκαίρως τη μοτοσικλέτα του. Το Εφετείο διαφώνησε με αυτή την προσέγγιση. Όπως αναφέρεται στην απόφαση, το κρίσιμο εύρημα ήταν ότι ο μοτοσικλετιστής είχε αντιληφθεί από κάποια απόσταση πως η πρόθεση του άλλου οδηγού δεν ήταν σαφής και ως αντίδραση άρχισε να μειώνει την ταχύτητά του. Δεν υπήρχε, όμως, εύρημα ότι είχε αντιληφθεί συγκεκριμένα πως ο οδηγός του αυτοκινήτου επρόκειτο να στρίψει δεξιά. Το Εφετείο τόνισε ότι η λέξη «ελάττωνε», που χρησιμοποίησε ο μοτοσικλετιστής, ήταν παρατατικός και περιέγραφε μια συνεχιζόμενη προσπάθεια μείωσης της ταχύτητας. Η ταχύτητά του είχε πλέον μειωθεί περίπου στα 25 έως 30 χιλιόμετρα την ώρα. Μέχρι εκείνο το χρονικό σημείο, σύμφωνα με το Εφετείο, δεν είχε ακόμη εκδηλωθεί συγκεκριμένος κίνδυνος σύγκρουσης, ώστε να υποχρεούται να λάβει επιπλέον μέτρα. Το κρίσιμο σημείο, σύμφωνα με την απόφαση, ήταν η στιγμή κατά την οποία ο οδηγός του αυτοκινήτου επιχείρησε τη δεξιά στροφή. Τότε ο μοτοσικλετιστής βρισκόταν ήδη πολύ κοντά στο σημείο εισόδου προς την πάροδο και, σύμφωνα με τη μαρτυρία που έγινε δεκτή, «ανέκοψε μου τον δρόμο, δεν είχα χρονικό διάστημα να αντιδράσω». Το Εφετείο έκρινε ότι, υπό αυτές τις συνθήκες, ο μοτοσικλετιστής δεν είχε ουσιαστικά χρόνο να αντιδράσει και να αποφύγει τη σύγκρουση. Η μοτοσικλέτα προσέκρουσε στην αριστερή μπροστινή πλευρά του αυτοκινήτου και, σύμφωνα με τη μαρτυρία του ίδιου του οδηγού, παρέμεινε κάτω από το όχημα, καθώς χτύπησε πάνω στον τροχό. Το Εφετείο υπενθύμισε παράλληλα ότι όταν ένας κίνδυνος εμφανίζεται ξαφνικά και δεν υπάρχει επαρκής χρόνος αντίδρασης, δεν μπορεί η συμπεριφορά του οδηγού να αξιολογείται εκ των υστέρων σαν να είχε στη διάθεσή του άπλετο χρόνο για ψύχραιμη σκέψη και επιλογή της ιδανικής αντίδρασης. Στην προκειμένη περίπτωση, το Δικαστήριο έκρινε ότι ο μοτοσικλετιστής δεν ήταν υποχρεωμένος να ακινητοποιήσει το όχημά του απλώς και μόνο επειδή υπήρχε μια αόριστη πιθανότητα ότι ο άλλος οδηγός θα του απέκοπτε την πορεία. Όταν τελικά εκδηλώθηκε ο κίνδυνος, η σύγκρουση ήταν πλέον αναπόφευκτη. Ιδιαίτερη αναφορά έγινε και στη νομολογιακή αρχή ότι ένας συνετός οδηγός δεν είναι υποχρεωμένος να λαμβάνει εκ των προτέρων μέτρα για να προστατευθεί από κάθε πιθανή αμελή συμπεριφορά άλλου οδηγού. Όπως επισημαίνει το Εφετείο, μια διαφορετική προσέγγιση θα επέβαλλε «ανυπόφορο βάρος» στον οδηγό που τηρεί τους κανόνες και θα οδηγούσε ουσιαστικά σε αδικαιολόγητη συγχώρεση εκείνου που παραβιάζει τα καθήκοντά του. Με βάση τα πιο πάνω, το Εφετείο έκρινε ότι εσφαλμένα αποδόθηκε στον μοτοσικλετιστή οποιοδήποτε ποσοστό ευθύνης. Οι δύο λόγοι της έφεσής του έγιναν δεκτοί, ενώ απορρίφθηκε ο λόγος της αντέφεσης με τον οποίο ο οδηγός του αυτοκινήτου ζητούσε αύξηση της ευθύνης του μοτοσικλετιστή. Και η ιατρική μαρτυρία υπέρ του μοτοσικλετιστή Το Εφετείο απέρριψε επίσης τις αιτιάσεις του οδηγού του αυτοκινήτου αναφορικά με την ιατρική μαρτυρία και τα κατάλοιπα που άφησαν οι τραυματισμοί. Ο μοτοσικλετιστής είχε υποστεί κάταγμα στη βάση της άπω φάλαγγας του μεγάλου δακτύλου του αριστερού ποδιού, ενώ είχε επίσης τραυματισμό στον αυχένα. Ο ορθοπεδικός δρ Αθάνατος είχε χαρακτηρίσει το κάταγμα «παρεκτοπισμένο ενδοαρθρικό κάταγμα» και είχε διαπιστώσει προβλήματα στην κίνηση του δακτύλου. Σε μεταγενέστερη εξέταση διαπίστωσε απώλεια 20% στην πελματιαία κάμψη και ανώμαλη επούλωση του κατάγματος. Ιδιαίτερη σημασία έδωσε το Εφετείο στην εξέταση του 2019. Ο δρ Αθάνατος διαπίστωσε τότε ότι το μεγάλο δάκτυλο παρουσίαζε κατά την κίνηση κριγμό, τον οποίο συνέδεσε με αρθρίτιδα. Η πρόβλεψη που είχε κάνει από το 2011 ήταν ότι η επιδείνωση και η ανάπτυξη αρθριτικών αλλοιώσεων στο μέλλον ήταν πολύ πιθανή. Το 2019, σύμφωνα με την απόφαση, διαπίστωσε ακριβώς αυτή την εξέλιξη. Το Εφετείο απέρριψε τις αιτιάσεις ότι η τρίτη εξέταση του μοτοσικλετιστή από τον δρα Αθάνατο δεν πραγματοποιήθηκε ή ότι έγινε με σκοπό να επηρεάσει το Δικαστήριο. Επισήμανε ότι η εξέταση είχε πράγματι πραγματοποιηθεί στις 3 Ιουνίου 2019, δύο ημέρες πριν από την κατάθεση του γιατρού, προκειμένου ο τελευταίος να έχει επικαιροποιημένη εικόνα της κατάστασης του ασθενούς. Το Εφετείο έκρινε, συνεπώς, ότι ορθά το πρωτόδικο Δικαστήριο προτίμησε τη μαρτυρία του δρος Αθανάτου, ο οποίος είχε εξετάσει τον μοτοσικλετιστή πιο πρόσφατα και είχε παραμείνει σταθερός στις θέσεις του ως προς τα μόνιμα κατάλοιπα του τραυματισμού. Οι λόγοι της αντέφεσης που αφορούσαν την αξιολόγηση των δύο ιατρών απορρίφθηκαν. Διατηρήθηκαν οι €10.000 για γενικές αποζημιώσεις Ο οδηγός του αυτοκινήτου είχε ζητήσει επίσης τη σημαντική μείωση των €10.000 που είχαν επιδικαστεί ως γενικές αποζημιώσεις. Το Εφετείο αναγνώρισε ότι οι τραυματισμοί είχαν χαρακτηριστεί πρωτοδίκως ως μη σοβαροί, αλλά υπογράμμισε ότι αυτό δεν σημαίνει πως ήταν ανύπαρκτοι ή χωρίς συνέπειες. Ο μοτοσικλετιστής είχε φορέσει αυχενικό κολάρο για περίπου ένα μήνα, είχε ακινητοποιημένο το πόδι του με νάρθηκα για περίπου τρεις εβδομάδες, χρησιμοποίησε πατερίτσες και απουσίασε από την εργασία του για περίπου τρεισήμισι μήνες. Παρά το γεγονός ότι επέστρεψε στην εργασία του και δεν χρειάστηκε χειρουργική επέμβαση, το Εφετείο έλαβε υπόψη τα μόνιμα κατάλοιπα που είχαν διαπιστωθεί, μεταξύ των οποίων η δυσκαμψία, η απώλεια πελματιαίας κάμψης και η αρθρίτιδα στο μεγάλο δάκτυλο. Έκρινε ότι το ποσό των €10.000, ακόμη και αν θεωρηθεί κάπως υψηλό, δεν βρισκόταν εκτός των εύλογων ορίων της διακριτικής ευχέρειας του πρωτόδικου Δικαστηρίου. Η τελική απόφαση Το Εφετείο έκανε δεκτή την έφεση του μοτοσικλετιστή και απέρριψε στο σύνολό της την αντέφεση του οδηγού του αυτοκινήτου. Ως αποτέλεσμα, η πρωτόδικη απόφαση τροποποιήθηκε και ο οδηγός του αυτοκινήτου υποχρεώνεται πλέον να καταβάλει στον μοτοσικλετιστή €16.040, πλέον νόμιμου τόκου. Συγκεκριμένα, επιδικάστηκε τόκος επί ποσού €10.000 από τις 13 Φεβρουαρίου 2013 μέχρι την εξόφληση, καθώς και επί ποσού €6.040 από τις 20 Απριλίου 2012 μέχρι την εξόφληση, με τον τόκο για το δεύτερο ποσό μειωμένο κατά το ήμισυ. Η ουσιαστική αλλαγή είναι ότι ο μοτοσικλετιστής απαλλάχθηκε πλήρως από το 30% της συντρέχουσας αμέλειας που του είχε καταλογιστεί πρωτοδίκως, με το Εφετείο να καταλήγει ότι η ξαφνική δεξιά στροφή του άλλου οδηγού και η ανακοπή της πορείας του αποτέλεσαν την αιτία της σύγκρουσης και ότι, όταν ο κίνδυνος εκδηλώθηκε, δεν υπήρχε πλέον χρόνος για αποτελεσματική αντίδραση. DBRS Ratings GmbH (Morningstar DBRS) has changed the trend on both the Republic of Cyprus’ long-term and short-term foreign and local currency issuer ratings to ‘positive’ from ‘stable’ on the view that Cyprus will maintain its strong fiscal position and continue reducing its public debt burden.
