Το Εφετείο ανέτρεψε πρωτόδικη απόφαση με την οποία είχαν επιδικαστεί γενικές και ειδικές αποζημιώσεις σε λιμενεργάτη, ο οποίος τραυματίστηκε κατά την εκφόρτωση πλοίου στο λιμάνι Λεμεσού το 2006, κρίνοντας ότι η αγωγή είχε καταχωριστεί εκπρόθεσμα και έπρεπε να ανασταλεί λόγω παραγραφής. Το ατύχημα σημειώθηκε στις 29 Ιουνίου 2006, ενώ η αγωγή καταχωρίστηκε στις 30 Δεκεμβρίου 2009, δηλαδή μετά την παρέλευση τριετίας. Η υπόθεση είχε αρχικά καταχωριστεί στο Ανώτατο Δικαστήριο, στη δικαιοδοσία Ναυτοδικείου, και στη συνέχεια παραπέμφθηκε για εκδίκαση στο Επαρχιακό Δικαστήριο Λεμεσού. Το πρωτόδικο Δικαστήριο είχε κρίνει υπεύθυνη την εφεσείουσα εταιρεία, θεωρώντας ότι ενεργούσε ως πράκτορας του πλοίου και ότι είχε την ευθύνη για τη διοργάνωση της εκφόρτωσης. Είχε, ως εκ τούτου, επιδικάσει αποζημιώσεις στον τραυματία. Απορρίφθηκαν οι ενστάσεις για τη δικαιοδοσία Το Εφετείο απέρριψε τους λόγους έφεσης που αφορούσαν τη δικαιοδοσία. Έκρινε ότι, με βάση τα όσα αναφέρονταν στο δικόγραφο του τραυματία, η υπόθεση αφορούσε ναυτική υπόθεση και μπορούσε να καταχωριστεί στη δικαιοδοσία Ναυτοδικείου. Συγκεκριμένα, στην Αναφορά αναφερόταν ότι η εταιρεία είχε την ευθύνη της εκφόρτωσης του πλοίου, ενώ είχε επίσης τον έλεγχο και την κατοχή του πλοίου. Το Εφετείο έκρινε ότι τα στοιχεία αυτά αρκούσαν ώστε η αξίωση να εμπίπτει στη ναυτική δικαιοδοσία. Παράλληλα, απορρίφθηκε και η θέση ότι το Επαρχιακό Δικαστήριο στερείτο δικαιοδοσίας επειδή το ποσό της αξίωσης υπερέβαινε τις €85.000. Το Εφετείο έκρινε ότι, σύμφωνα με το ισχύον νομοθετικό πλαίσιο, το Επαρχιακό Δικαστήριο είχε δικαιοδοσία να εκδικάσει τη συγκεκριμένη υπόθεση που του είχε παραπεμφθεί. Το κρίσιμο ζήτημα της παραγραφής Το σημείο που τελικά έκρινε την τύχη της αγωγής ήταν η παραγραφή. Το πρωτόδικο Δικαστήριο είχε διαπιστώσει ότι εφαρμοζόταν το αγγλικό δίκαιο, σύμφωνα με το οποίο για αξιώσεις λόγω σωματικών βλαβών προβλεπόταν τριετής περίοδος παραγραφής. Ωστόσο, είχε αποφασίσει να μην αναστείλει την αγωγή, θεωρώντας ότι η εταιρεία είχε αδρανήσει και δεν είχε εγείρει το ζήτημα στο κατάλληλο στάδιο της διαδικασίας. Η εταιρεία είχε, ωστόσο, θέσει το ζήτημα της παραγραφής ήδη από τα δικόγραφά της. Στη συνέχεια υπέβαλε και ενδιάμεση αίτηση για την εξέτασή του, ενώ το ζήτημα επανήλθε και κατά την τελική αγόρευση. Το Εφετείο έκρινε ότι η «αδράνεια» που αποδόθηκε στην εταιρεία από το πρωτόδικο Δικαστήριο δεν τεκμηριωνόταν από τα γεγονότα, αλλά ούτε μπορούσε να θεωρηθεί ότι συνιστούσε εγκατάλειψη του δικαιώματός της να επικαλεστεί την παραγραφή. Δεν αποδείχθηκε διακοπή της παραγραφής Ο τραυματίας είχε υποστηρίξει ότι πριν από την επίδικη αγωγή είχε καταχωρίσει άλλη αγωγή, στις 6 Ιουνίου 2008, για το ίδιο ατύχημα και τις ίδιες σωματικές βλάβες. Η προηγούμενη αγωγή, σύμφωνα με τον ισχυρισμό του, αποσύρθηκε στις 31 Νοεμβρίου 2009, με αποτέλεσμα να θεωρεί ότι ο χρόνος παραγραφής είχε διακοπεί. Ωστόσο, το Εφετείο διαπίστωσε ότι οι συγκεκριμένοι ισχυρισμοί δεν είχαν δικογραφηθεί στην Αναφορά του τραυματία ούτε είχαν παρουσιαστεί τα απαραίτητα αποδεικτικά στοιχεία κατά την κύρια δίκη. Μάλιστα, παρά τις παρατηρήσεις του πρωτόδικου Δικαστηρίου, ο Εφεσίβλητος δεν επιδίωξε τροποποίηση της δικογραφίας του ώστε να εντάξει τους σχετικούς ισχυρισμούς, ούτε παρουσίασε μαρτυρία που να αποδεικνύει τη διακοπή της παραγραφής. Ως αποτέλεσμα, το Εφετείο έκρινε ότι δεν υπήρχε το απαιτούμενο πραγματικό υπόβαθρο για να θεωρηθεί ότι η παραγραφή είχε διακοπεί. Η απόφαση του Εφετείου Το Εφετείο κατέληξε ότι η πρωτόδικη κρίση πως η υποτιθέμενη αδράνεια της εταιρείας την εμπόδιζε να ζητήσει αναστολή της αγωγής λόγω παραγραφής ήταν εσφαλμένη. Ο σχετικός λόγος έφεσης έγινε δεκτός και, ως αποτέλεσμα, η έφεση επιτεύχθηκε. Η πρωτόδικη απόφαση παραμερίστηκε και αντικαταστάθηκε με απόφαση αναστολής της αγωγής. Παράλληλα, τα έξοδα της πρωτόδικης διαδικασίας επιδικάστηκαν υπέρ της εφεσείουσας εταιρείας και εναντίον του τραυματία, ενώ για την έφεση επιδικάστηκαν επιπλέον €4.000 πλέον ΦΠΑ, εάν υπάρχει, υπέρ της εταιρείας. Το Εφετείο, πάντως, ολοκληρώνοντας την απόφασή του, εξέφρασε τη λύπη του για την κατάληξη της υπόθεσης, σημειώνοντας ότι οι περιστάσεις που οδήγησαν στον παραμερισμό της απόφασης με την οποία είχαν επιδικαστεί αποζημιώσεις δεν αφορούσαν τον τρόπο με τον οποίο συνέβη το ατύχημα ούτε τις βλάβες που υπέστη ο τραυματίας, αλλά διαδικαστικά και νομικά ζητήματα. Το νέο Διοικητικό Συμβούλιο ενισχύει τον θεσμικό ρόλο του Κυπριακού Συνδέσμου Διεύθυνσης Ανθρώπινου Δυναμικού μέσα από απευθείας διάλογο με την Πολιτεία και τους κορυφαίους εκπροσώπους της επιχειρηματικής κοινότητας Με μια σειρά σημαντικών θεσμικών επαφών με τους βασικούς φορείς που διαμορφώνουν την αγορά εργασίας στην Κύπρο, το νέο Διοικητικό Συμβούλιο του Cyprus Human Resource Management Association (CyHRMA) σηματοδοτεί μια νέα περίοδο ενεργού παρουσίας και ουσιαστικής συμμετοχής του Συνδέσμου στον διάλογο για το μέλλον της εργασίας. Κατά τις τελευταίες εβδομάδες, αντιπροσωπείες του Διοικητικού Συμβουλίου με επικεφαλής την πρόεδρο του κα Αθηνά Νεοφυτου πραγματοποίησαν συναντήσεις με τον Υπουργό Εργασίας και Κοινωνικών Ασφαλίσεων κ. Μαρίνο Μουσιούττα, την ηγεσία του Κυπριακού Εμπορικού και Βιομηχανικού Επιμελητηρίου (ΚΕΒΕ) και την ηγεσία της Ομοσπονδίας Εργοδοτών & Βιομηχάνων (ΟΕΒ). Οι συναντήσεις είχαν ως κοινό παρονομαστή την ενίσχυση του θεσμικού διαλόγου και την ανάδειξη του ρόλου του ανθρώπινου δυναμικού ως κρίσιμου παράγοντα για την ανταγωνιστικότητα των επιχειρήσεων, την παραγωγικότητα και τη βιώσιμη ανάπτυξη της κυπριακής οικονομίας. Στη συνάντηση με τον Υπουργό Εργασίας, το νέο Διοικητικό Συμβούλιο παρουσίασε τις προτεραιότητες του και συζήτησε τρόπους με τους οποίους ο CyHRMA μπορεί να συμβάλει πιο ενεργά στον διάλογο για την αγορά εργασίας, τις σύγχρονες εργασιακές πρακτικές, την ανάπτυξη του ανθρώπινου δυναμικού και τις προκλήσεις που δημιουργούν οι νέες μορφές εργασίας και η Τεχνητή Νοημοσύνη. Ακολούθησε συνάντηση με την ηγεσία του ΚΕΒΕ, με τον Γενικό Γραμματέα κ. Φιλόκυπρο Ρουσουνίδη και εκπροσώπους του Τμήματος Εργασιακών Σχέσεων. Η συζήτηση επικεντρώθηκε στη σημασία της στενότερης συνεργασίας μεταξύ των δύο οργανισμών και στη δυνατότητα ανάπτυξης κοινών πρωτοβουλιών προς όφελος των επιχειρήσεων, των επαγγελματιών στον τομέα του HR και της κυπριακής αγοράς εργασίας. Ο κύκλος των επαφών ολοκληρώθηκε με συνάντηση με την ηγεσία της ΟΕΒ, τον Πρόεδρο κ. Γιώργο Παντελίδη, τον Γενικό Διευθυντή κ. Μιχάλη Αντωνίου και τη Διευθύντρια Ανθρώπινου Δυναμικού κα Μαρία Στυλιανού Θεοδώρου. Στο επίκεντρο βρέθηκαν η ενίσχυση της συνεργασίας, η ανταλλαγή απόψεων και η διερεύνηση κοινών δράσεων για τις προκλήσεις και τις ευκαιρίες που αντιμετωπίζει η κυπριακή αγορά εργασίας. Οι πρόσφατες αυτές επαφές αποτελούν ένα σημαντικό πρώτο βήμα για το νέο Διοικητικό Συμβούλιο του CyHRMA και αντανακλούν μια ξεκάθαρη στρατηγική επιλογή: Ο CyHRMA δεν θέλει απλώς να παρακολουθεί τις εξελίξεις στην αγορά εργασίας. Θέλει να συμμετέχει ενεργά στη διαμόρφωση τους. Ως ο μεγαλύτερος επαγγελματικός φορέας των στελεχών και επαγγελματιών Ανθρώπινου Δυναμικού στην Κύπρο, ο CyHRMA επιδιώκει να μεταφέρει τη γνώση, την εμπειρία και τις καθημερινές προκλήσεις των επαγγελματιών του HR στο επίπεδο του θεσμικού διαλόγου και της χάραξης πολιτικής. Η σημερινή πραγματικότητα απαιτεί μια ισχυρότερη φωνή για το HR. Η προσέλκυση και διακράτηση ταλέντου, οι δεξιότητες του μέλλοντος, η παραγωγικότητα, η εργασιακή ευημερία, η αξιοποίηση της Τεχνητής Νοημοσύνης, η ηγεσία, η δημογραφική αλλαγή και η εξέλιξη των εργασιακών σχέσεων δεν αποτελούν πλέον αποκλειστικά ζητήματα των τμημάτων HR. Αποτελούν ζητήματα που επηρεάζουν άμεσα την ανταγωνιστικότητα της κυπριακής οικονομίας. Για τον λόγο αυτό, ο CyHRMA θα συνεχίσει να επενδύει στη δημιουργία σταθερών και ουσιαστικών σχέσεων συνεργασίας με την Πολιτεία, τους εργοδοτικούς οργανισμούς, τους κοινωνικούς εταίρους, την ακαδημαϊκή κοινότητα και άλλους σημαντικούς φορείς. Στόχος είναι ένας και ξεκάθαρος: Να γίνει η φωνή του HR ένας ουσιαστικός παράγοντας στη διαμόρφωση του μέλλοντος της εργασίας στην Κύπρο. Το νέο Διοικητικό Συμβούλιο του CyHRMA καλεί παράλληλα τα μέλη του Συνδέσμου να συμμετέχουν ενεργά σε αυτή την προσπάθεια, καταθέτοντας τις εμπειρίες, τις ιδέες και τις προτάσεις τους. Προς τούτο, το νέο Διοικητικό Συμβούλιο ετοιμάζεται να ανακοινώσει μια σειρά από ενέργειες με στόχο την ενίσχυση της επικοινωνίας μεταξύ των μελών του, προσφέροντας τους το βήμα για να αποκτήσουν ρόλο και λόγο στα εργασιακά δρώμενα της Κύπρου. DBRS Ratings GmbH (Morningstar DBRS) has changed the trend on both the Republic of Cyprus’ long-term and short-term foreign and local currency issuer ratings to ‘positive’ from ‘stable’ on the view that Cyprus will maintain its strong fiscal position and continue reducing its public debt burden.
