Σημαντικό βήμα για την ενίσχυση της διαφάνειας, της ακεραιότητας και της λογοδοσίας στη διαχείριση των τουρκοκυπριακών περιουσιών αποτελεί η εφαρμογή του διεθνούς προτύπου ISO 37001 – Σύστημα Διαχείρισης κατά της Δωροδοκίας και της Διαφθοράς στην Υπηρεσία Διαχείρισης Τουρκοκυπριακών Περιουσιών, αναφέρει σε ανακοίνωσή του το Υπουργείο Εσωτερικό. Όπως σημειώνεται, η εφαρμογή του ISO 37001 στην Υπηρεσία εντάσσεται στη συνολική προσπάθεια της Κυβέρνησης για εκσυγχρονισμό και εξορθολογισμό της διαχείρισης των τουρκοκυπριακών περιουσιών, με επίκεντρο τη διαφάνεια, την αντικειμενικότητα, τη λογοδοσία και την ακεραιότητα. Σύμφωνα με την ανακοίνωση, στο πλαίσιο της μεταρρύθμισης του τρόπου διάθεσης και διαχείρισης των τουρκοκυπριακών περιουσιών, εφαρμόζεται από τον Ιούλιο 2025 το νέο νομοθετικό πλαίσιο, μέσω του οποίου καθιερώθηκαν αντικειμενικά και μετρήσιμα κριτήρια, περιορίστηκε η διακριτική ευχέρεια του εκάστοτε Υπουργού Εσωτερικών, ως Κηδεμόνα των τουρκοκυπριακών περιουσιών, και εφαρμόστηκε σύστημα επιλεξιμότητας και μοριοδότησης των αιτητών. Στόχος, σημειώνεται, είναι να διασφαλίζεται η διαφάνεια, η ισονομία και η αξιοκρατία ανάμεσα στον προσφυγικό κόσμο. Την ίδια ώρα, επισημαίνεται ότι κατά την τελευταία τριετία εντατικοποιήθηκαν οι έλεγχοι των συμβάσεων μίσθωσης τουρκοκυπριακών περιουσιών και λήφθηκαν μέτρα ανάκτησης ή/και νομικά για τις περιπτώσεις όπου εντοπίστηκαν παραβιάσεις των όρων της σύμβασης. Η παρουσίαση της εφαρμογής του προτύπου θα πραγματοποιηθεί τη Δευτέρα, 28 Σεπτεμβρίου 2026, στο Υπουργείο Οικονομικών (αίθουσα πολλαπλών χρήσεων), στην παρουσία του Υπουργού Εσωτερικών Κωνσταντίνου Ιωάννου. Σε ισχύ παρέμεινε από το Εφετείο η ποινή φυλάκισης 18 μηνών που επιβλήθηκε σε άνδρα για κλοπή ηλεκτρικού μοτοποδηλάτου, με το Δικαστήριο να κρίνει ότι η διάπραξη και άλλου αδικήματος μετά την κλοπή, το οποίο επίσης παραδέχθηκε ο καταδικασθείς, ήταν επιβαρυντικό στοιχείο και δεν επέτρεπε την αναστολή της ποινής. Η απόφαση του Εφετείου, ημερομηνίας 24 Σεπτεμβρίου 2026, αφορά υπόθεση κλοπής ηλεκτρικού μοτοποδηλάτου αξίας €1.500. Κατά την επιβολή της ποινής από το πρωτόδικο δικαστήριο είχαν ληφθεί υπόψη ακόμη δύο υποθέσεις που ο εφεσείων είχε παραδεχθεί, η μία για κλεπταποδοχή ηλεκτρικού σκούτερ αξίας €470 και η άλλη για εξασφάλιση πίστωσης ύψους €134,50 με ψευδείς παραστάσεις. Το πρωτόδικο δικαστήριο του επέβαλε ποινή φυλάκισης 18 μηνών και διέταξε να εκτελεστεί άμεσα. Ενώπιον του Εφετείου, ο εφεσείων αρχικά υποστήριξε ότι η ποινή ήταν υπερβολική, όμως ο συγκεκριμένος λόγος έφεσης αποσύρθηκε κατά την ακρόαση. Η έφεση περιορίστηκε έτσι στον δεύτερο λόγο, σύμφωνα με τον οποίο, το πρωτόδικο δικαστήριο θα έπρεπε να αναστείλει την ποινή φυλάκισης, θεωρώντας ότι δεν άσκησε ορθά τη διακριτική του ευχέρεια με την επιβολή της άμεσης εκτέλεσής της. Η συνήγορος του εφεσείοντα υποστήριξε ότι θα έπρεπε να δοθεί μεγαλύτερη βαρύτητα στο λευκό ποινικό του μητρώο, στην παραδοχή των αδικημάτων, στη μεταμέλειά του και στο γεγονός ότι τα κλοπιμαία είχαν εντοπιστεί και επιστραφεί στους ιδιοκτήτες τους. Προβλήθηκε επίσης ότι η άμεση φυλάκιση θα είχε ιδιαίτερα επαχθείς συνέπειες για τον ίδιο και την οικογένειά του. Από την πλευρά του, ο συνήγορος της Κατηγορούσας Αρχής έδωσε ιδιαίτερη βαρύτητα στη συμπεριφορά του εφεσείοντα μετά την κλοπή του μοτοποδηλάτου. Όπως αναφέρεται στην απόφαση, η κλοπή διαπράχθηκε τον Ιούνιο του 2024, ενώ τον Νοέμβριο του 2024 ο εφεσείων διέπραξε το αδίκημα της εξασφάλισης πίστωσης με ψευδείς παραστάσεις, το οποίο παραδέχθηκε και λήφθηκε υπόψη κατά την επιβολή της ποινής στην προσβαλλόμενη απόφαση. Ο συνήγορος ανέφερε ότι «η διαγωγή του εφεσείοντα μετά τη διάπραξη του αδικήματος της παρούσας υπόθεσης είναι επιβαρυντική και του αφαιρεί κάθε έρεισμα προσδοκίας για αναστολή εκτέλεσης της ποινής φυλάκισης που επιβλήθηκε». Το Εφετείο έκρινε ότι το πρωτόδικο δικαστήριο είχε λάβει υπόψη όλα τα σχετικά στοιχεία, μεταξύ άλλων τη σοβαρότητα των αδικημάτων, τις προσωπικές περιστάσεις του εφεσείοντα, το λευκό ποινικό μητρώο του, την παραδοχή του και την επιστροφή των κλοπιμαίων. Ωστόσο, σημείωσε ότι τα στοιχεία αυτά δεν μπορούσαν να οδηγήσουν σε αναστολή της ποινής, επισημαίνοντας ότι «τα προσωπικά δεδομένα του εφεσείοντα, συμπεριλαμβανομένων και των ελαφρυντικών παραγόντων που συγκεντρώνει στο πρόσωπο του (λευκό ποινικό μητρώο, παραδοχή, επιστροφή των αντικείμενων), δεν μπορούν να υπερφαλαγγίσουν το δημόσιο συμφέρον το οποίο επιτάσσει την επιβολή αποτρεπτικών ποινών, τόσο λόγω της σοβαρότητας των αδικημάτων που έχει παραδεχτεί ότι έχει διαπράξει ο εφεσείοντας αλλά και της έξαρσης στην οποία βρίσκονται αυτής της φύσης τα αδικήματα». Το Εφετείο στάθηκε ιδιαίτερα στη διάπραξη του δεύτερου αδικήματος μετά την κλοπή, κρίνοντας ότι η μεταγενέστερη διαγωγή του εφεσείοντα ήταν επιβαρυντική. «Η διαγωγή του μετά τη διάπραξη του αδικήματος που αφορά η παρούσα υπόθεση είναι επιβαρυντική και όντως υπό τις περιστάσεις δεν δικαιολογούσε την αναστολή εκτέλεσης της ποινής που του έχει επιβληθεί», αναφέρει. Παράλληλα, το Εφετείο σημείωσε ότι η απόφαση για αναστολή ποινής ανήκει στη διακριτική ευχέρεια του πρωτόδικου δικαστηρίου και ότι η κάθε υπόθεση πρέπει να κρίνεται με βάση τις ιδιαίτερες περιστάσεις της. Καταλήγοντας, έκρινε ορθή την επιλογή του πρωτόδικου δικαστηρίου για άμεση φυλάκιση, σημειώνοντας ότι η συμπεριφορά του εφεσείοντα «καταδεικνύει ότι κάθε άλλο παρά δικαιολογούσε την αναστολή των ποινών φυλάκισης που του έχουν επιβληθεί».
