Την άμεση, πλήρη και οριζόντια εφαρμογή της δικαστικής απόφασης της 8ης Οκτωβρίου 2020 (Υπόθεση αρ. 1368/2014) και την ολοκληρωμένη αποκατάσταση όλων των επηρεαζομένων για την περίοδο 2013–2026, ζητούν οι εργαζόμενοι στα Υποστηρικτικά Προγράμματα του Υπουργείου Παιδείας, Αθλητισμού και Νεολαίας. Σε υπόμνημα τους μεταξύ άλλων προς το Υπουργείο Παιδείας, Αθλητισμού και Νεολαίας, το Υπουργείο Εργασίας και Κοινωνικών Ασφαλίσεων, Τμήμα Κοινωνικών Ασφαλίσεων, τις Επιτροπές Παιδείας και Εργασίας της Βουλής και τις συντεχνίες ΠΑΣΕΥ-ΠΕΟ και ΟΕΚΔΥ-ΣΕΚ, οι εργαζόμενοι στα Υποστηρικτικά Προγράμματα του Υπουργείου Παιδείας αναφέρονται στο ιστορικό και νομικό υπόβαθρο του θέματος τους και προσθέτουν ότι στις 8 Οκτωβρίου 2020 το Διοικητικό Δικαστήριο έκρινε ότι «η απόφαση του Διευθυντή Κοινωνικών Ασφαλίσεων να κατατάξει τους εργαζομένους ως αυτοεργοδοτούμενους ήταν εσφαλμένη, αποτέλεσμα μη δέουσας έρευνας και αναιτιολόγητη». «Παρά τη δικαστική αυτή κρίση, έξι χρόνια μετά εξακολουθούν να υφίστανται περίοδοι χωρίς εισόδημα, μη πλήρης αποκατάσταση ασφαλιστικών και εργασιακών δικαιωμάτων και καθυστερήσεις στην εφαρμογή των συνεπειών της απόφασης», προσθέτουν. Επίσης οι εργαζόμενοι στα Υποστηρικτικά Προγράμματα του Υπουργείου Παιδείας ζητούν άμεση, πλήρη και οριζόντια εφαρμογή του δικαίου για όλους τους επηρεαζόμενους από το 2013 έως σήμερα. Συγκεκριμένα, ζητούν μεταξύ άλλων αναγνώριση της πραγματικής εργασιακής σχέσης ως μισθωτής όπου τα πραγματικά περιστατικά το επιτρέπουν, με βάση την απόφαση του 2020 και τη συναφή νομολογία, αναδρομική αποκατάσταση ασφαλιστικών δικαιωμάτων για την περίοδο 2013–2026, καταβολή όλων των δεδουλευμένων και αποζημίωση για τις περιόδους χωρίς εισόδημα, διασφάλιση εισοδήματος κατά τις περιόδους που τα προγράμματα δεν λειτουργούν (επίδομα ανεργίας ή ισοδύναμη ρύθμιση) και ίση μεταχείριση με άλλους εργαζομένους αορίστου χρόνου του δημόσιου τομέα. Αναφορικά με τις άμεσες ενέργειες τους, οι εργαζόμενοι αναφέρουν ότι αυτές είναι η συγκέντρωση πλήρους φακέλου (συμβάσεις, αποδείξεις πληρωμών, αλληλογραφία, στοιχεία περιόδων χωρίς εισόδημα), η αποστολή ατομικού ή συλλογικού υπομνήματος στα Υπουργεία με αναφορά στην απόφαση του 2020 και η καταχώρηση προσφυγής στο Διοικητικό Δικαστήριο βάσει του Άρθρου 146 του Συντάγματος (προθεσμία 75 ημερών). Οι εργαζόμενοι στα Υποστηρικτικά Προγράμματα του Υπουργείου Παιδείας ζητούν από τις συντεχνίες ΠΑΣΕΥ-ΠΕΟ και ΟΕΚΔΥ-ΣΕΚ να αναλάβουν συλλογική νομική δράση για οριζόντια εφαρμογή της απόφασης, να καταθέσουν συλλογικά υπομνήματα και να παρακολουθούν την εφαρμογή και να ενημερώνουν δημόσια και διαφανώς τους εργαζομένους.
